Contest Rules

NO PURCHASE NECESSARY. PURCHASE WILL NOT INCREASE CHANCE OF WINNING. Entry in this Contest constitutes acceptance of these Official Rules. Approximately $10,400.00 USD in total prize value.

  1. DESCRIPTION OF THE CONTEST. The “I Will Remember for You Family Reunion Giveaway” Contest (“Contest”), sponsored by Home Instead, Inc. (“Sponsor”), is designed to give entrants (“Entrants”) the opportunity to submit an essay in either written or video format to explain why they deserve to win a free family reunion, subject to the terms below. To be eligible to enter this Contest, the Entrant must have or have had a family member who was diagnosed as having Alzheimer’s disease or other dementias (collectively, “Alzheimer’s Disease”).

    The “I Will Remember for You Family Reunion Giveaway” Contest will take place on the Contest’s landing page at http://www.rememberforalzheimers.com/.

    Three finalists from the list of all qualified Entrants will be chosen by a panel of judges, who will adhere to the judging criteria listed in section 6 below, and these finalists will be determined in the judges’ sole discretion in accordance with these Official Contest Rules. Each of these three finalists will be contacted to develop a separate finalist video (“Finalist Video”) that highlights the Entrant’s family’s challenges in caring for their loved one with Alzheimer’s Disease and why the Entrant believes his or her family deserves to win the family reunion. These three Finalist Videos will be made available on the Contest’s landing page for the public to vote on one final winner. A free family reunion, worth a maximum value of $10,000.00 (the “Grand Prize”), will be awarded to the Entrant whose Finalist Video receives the most votes, as further explained in section 7a below. In the event the Grand Prize winner’s family member with Alzheimer’s Disease does not attend the family reunion, Sponsor will arrange for a local Home Instead Senior Care® office or another provider to provide the family member up to a maximum of sixteen (16) hours of in-home caregiving services (to be used in minimum four-hour increments over a maximum of three days) (worth approximately $400).

  2. ELIGIBILITY. This Contest is only open to legal U.S. residents who are 18 years of age or older as of November 15, 2011 and Canadian residents (excluding the province of Quebec) who are of or above the age of majority in their province or territory of residence as of November 15, 2011. Employees and directors of Sponsor, or of any Home Instead Senior Care® franchise office, and their respective subsidiaries and affiliated companies, advertising, promotion, or production agencies, web masters and web suppliers (and their respective IRS dependents (for U.S. residents), immediate family members and individuals residing in the same household) are not eligible to participate. Void in Puerto Rico, Quebec and where prohibited.

    To be eligible for the Grand Prize, the Entrant must have or have had a family member who was diagnosed as having Alzheimer’s Disease.

  3. ENTRY PERIOD. This Contest begins at 12:00 a.m. Eastern Daylight Time (EDT) on November 15, 2011, and ends at 11:59 p.m. EST on January 31, 2012 (“Contest Period”).

  4. HOW TO ENTER. Entry forms and essays (collectively, the “Entry”) must be received electronically no later than 11:59 p.m. EST on January 31, 2012 (the “Entry Deadline”). To electronically enter this Contest, go to http://www.rememberforalzheimers.com/, and complete and submit your Entry. Entries received after the Entry Deadline will not be accepted.

  5. ENTRY REQUIREMENTS. All Entries must include:

    • An essay in either written or video format. While a video essay is not required, nor is there a required format for any video essay, a sample of how to simply film a video will be included on the Contest’s landing page to assist Entrants. All essays, whether in written or video format, will receive equal consideration. Photos may also be submitted, but will not be required.

      • Essays need to:

        • Share the role that memories and remembering have played or played in Entrant’s family, in particular how they have been or were important to Entrant with regard to Entrant’s family member who now has or had Alzheimer’s Disease

        • Tell why Entrant believes his or her family deserves to win this family reunion

        • Share how Alzheimer’s Disease has impacted Entrant’s life

        • Share specific stories or examples of how Entrant copes or coped with his or her family member’s Alzheimer’s Disease

    • The Entrant’s full name, valid e-mail address and telephone number will be required.

    To the extent any Entry includes a photograph and/or video, Entrant represents and warrants that he or she has obtained the consent of each person who appears in the photograph and/or video to license, sublicense, reproduce, distribute, modify, edit, adapt and/or create derivative works from the photograph and/or video. Entrant shall, at Entrant’s expense, indemnify, defend and hold harmless Sponsor and each Home Instead Senior Care® franchise office, and their respective officers, directors, employees and agents, from any and all costs, damages, expenses, liability, claims and proceedings (including reasonable attorneys’ fees) arising out of or resulting from any suit or action brought by a third party, including without limitation persons appearing in the photograph and/or video, to the extent that the suit or action is based upon a claim that Sponsor’s use of the photograph and/or video infringes any of such third party’s privacy, intellectual property and/or other rights. Entrants may enter as many separate Entries as they like; however, each Entrant is only eligible to win one Grand Prize. Once submitted, all Entries and accompanying materials become the property of Sponsor and will not be returned to Entrant. Sponsor is not responsible for lost, late, illegible, incomplete, mutilated, misdirected, or stolen Entries or Entries not received by the Entry Deadline. Sponsor reserves the right in its sole discretion to disqualify any Entry at any time for which, in Sponsor’s sole opinion, it is determined that the Entrant is in violation of these Official Rules.

  6. THREE FINALIST WINNERS SELECTION:

    1. On January 31, 2012 at 11:59 p.m. EST all Entries must have been received and the Contest Period will be closed. All Entries will be judged based on the following criteria:

      • Does the Entrant have a family member who has been or was diagnosed as having Alzheimer’s Disease? What roles does or did this family member play?

      • How compelling is the Entrant’s story regarding the reasons for believing his or her family deserves to win the family reunion? Is this a story that the judges think will engage other consumers and cause them to vote for this family?

      • How compelling are the public’s comments, if any, on the story? (All public comments must be received during the Contest Period to be considered by the judging panel, which is further described below. The judging panel will not consider any public comments received after the Contest Period.) Are there unique or special considerations that make this story more compelling than the other stories submitted? What is the overall level of engagement with this story?

      • Did the Entry satisfy all of the other criteria listed in section 5 above?

      • Are there any objective considerations as to why an Entry should not be included in the judging?

    2. Judging will be conducted by a panel of five members. Three finalists will be chosen from all qualified Entries. The three finalists will be determined by February 8, 2012. By February 15, 2012, the three finalists will be notified and asked to sign all pertinent forms as further described in section 9 below.

    3. Upon securing the above referenced signed forms, each of the three finalists will be contacted to develop a separate Finalist Video that highlights his or her family’s challenges in caring for a family member with Alzheimer’s Disease and why he or she believes his or her family deserves to win the family reunion. These Finalist Videos will be solely produced by Sponsor’s online marketing agency of record. All Finalist Videos must be completed by March 23, 2012 and will be made publically available on March 28, 2012 for the public’s voting to determine the Grand Prize winner, as detailed in section 7a below.

  7. GRAND PRIZE WINNER SELECTION:

    • Grand Prize Winner Selection

      • Public voting to determine the Grand Prize winner will take place on the Contest’s landing page at http://www.rememberforalzheimers.com/. The voting period will begin at 12:00 a.m. EST on March 28, 2012, and end at 11:59 p.m. EST on June 30, 2012 (the “Voting Period”). Votes must be received electronically no later than 11:59 p.m. EST on June 30, 2012 (the “Voting Deadline”). To electronically vote in this Contest, go to http://www.rememberforalzheimers.com/, select an Entry, and complete the voting process. Votes received after the Voting Deadline will not be accepted. Of the three finalists, the person whose Finalist Video receives the most public votes during the Voting Period will be awarded the free family reunion, worth a maximum value of $10,000.00. Only one vote per person per each day of the Voting Period will be allowed. In the event of a tie, the Grand Prize winner will be chosen at random using a mechanism selected at Sponsor’s sole discretion. The Grand Prize winner will be notified no later than July 13, 2012. Before being declared the Grand Prize winner, the selected Entrant shall comply with these Official Rules, sign and return all applicable documents (as further described in section 9 below) and, if the Grand Prize winner is a resident of Canada, be required to correctly answer, without assistance of any kind, a time-limited mathematical skill-testing question.

    • Other Grand Prize Conditions

      • Actual Grand Prize details at Sponsor’s sole discretion. Other restrictions may apply.

      • In addition to any applicable travel costs as further described in section 8 below, the Grand Prize winner is solely responsible for all expenses and costs related to the Grand Prize but not specifically set forth herein, including taxes and fees.

      • The Grand Prize is not transferable and cannot be assigned, redeemed for cash, or substituted (except by Sponsor, in its sole discretion). Once the Grand Prize is awarded, no alternative or substitute prize will be awarded.

      • Any difference between the actual and stated values of the Grand Prize and/or the caregiving services referenced in section 8 below will not be awarded.

      • In no event will Sponsor be obligated to award more than one Grand Prize. In the event of the Grand Prize’s unavailability, Sponsor reserves the right to substitute a prize of equal or greater value.

  8. THE GRAND PRIZE FAMILY REUNION EVENT. Sponsor’s online marketing agency of record will be responsible for all planning and coordination for the family reunion. The entire event will be funded, up to a maximum amount of $10,000. Notwithstanding the foregoing, Sponsor will not pay or reimburse the Grand Prize winner for the travel costs incurred by the Grand Prize winner and his or her family to attend the event. The specific date of the event will be coordinated with the Grand Prize winner upon acceptance of the Grand Prize. Whether the Alzheimer’s Disease sufferer attends the reunion or remains at home will be at the discretion of the Grand Prize winner and his or her family. If the Grand Prize winner’s family member with Alzheimer’s Disease does not attend the reunion, Sponsor will arrange for a local Home Instead Senior Care® office or another provider to provide the family member up to a maximum of sixteen (16) hours of in-home caregiving services (to be used in minimum four-hour increments over a maximum of three days)(worth approximately $400). The Grand Prize winner acknowledges, understands and agrees that, in the event he or she elects to use an alternative provider of caregiving services or seeks additional caregiving services, neither Sponsor nor any of the Home Instead Senior Care® franchise offices shall be responsible or liable in any way for the provision of such alternative or additional caregiving services.

    Video will be taken throughout the family reunion to be used to create a webisode that will announce the Grand Prize winner in November 2012 and/or other publicity or marketing materials related to or arising from the Contest. As a condition of winning the Grand Prize, the Grand Prize winner and his or her family agree to provide Sponsor and Sponsor’s online marketing agency of record access to the family reunion for purposes of taking video of the family reunion, and to provide any necessary written documentation relating to such access upon Sponsor’s request.

  9. RIGHTS AND PUBLICITY. By submitting an Entry, each Entrant: (a) grants to the Sponsor the right to use his or her name, mailing address, telephone number, and e-mail address (“Personal Information”) for the purpose of administering the Contest, including but not limited to contacting and announcing the Grand Prize winner; (b) grants to the Sponsor the right to use his or her name, likeness, Entry, photograph and video for publicity and promotional purposes relating to this Contest or similar promotions, in any and all media now known or hereafter devised without further compensation unless prohibited by law; and (c) acknowledges that the Sponsor may disclose his or her Personal Information to third party agents and service providers of the Sponsor in connection with any of the activities listed in (a) and (b) above. The Sponsor will use the Personal Information only for these identified purposes, and protect the Personal Information in a manner that is consistent with the Sponsor’s privacy policy located at www.homeinstead.com. By submitting an Entry, Entrant acknowledges, agrees, represents and warrants that: (a) he or she owns all content in the Entry submitted, has permission to use any material included in the Entry, and has permission from anyone referenced or featured in the Entry to use his or her name and/or likeness for publicity and promotional purposes relating to the Contest or similar promotions; (b) any stories Entrant submits, and any copyright in the stories, shall be deemed to the property of, and all right and title in the stories in Entrant’s Entry and any copyrights therein are hereby assigned to Lori Hogan, Paul Hogan and/or Sponsor; (c) if it is determined that any of the stories in Entrant’s Entry, or any part thereof, have not been assigned to Lori Hogan, Paul Hogan and/or Sponsor, Entrant hereby grants each of them a perpetual, exclusive and royalty-free license in the stories in Entrant’s Entry; and (d) nothing in the Entry violates any third person’s intellectual property, privacy or other rights. Should Lori Hogan, Paul Hogan and/or Sponsor reprint any content of Entrant’s Entry, Entrant acknowledges that this content may be adapted and rewritten to fit publication format. By submitting an Entry and/or accepting the Grand Prize, each Entrant and/or Grand Prize winner agrees to and does hereby assign and transfer to Sponsor all right, title, and interest in and to the Entry, including and not limited to the copyright and moral rights, worldwide, in the original winning Entry subject to reserving rights for the Grand Prize winner's private/non-commercial use only, allowing the Sponsor and those acting pursuant to Sponsor's direction, to use the Entry for advertising, trade, promotional, or any purpose worldwide, and on the Internet or any medium, without review or approval by, or notification to, the Entrant and/or the Grand Prize winner. Each Entrant and/or Grand Prize winner agrees to execute all documents deemed necessary by Sponsor to record and perfect any such assignment and transfer. The Grand Prize winner will be required to complete, sign and return a Statement of Eligibility & Liability/Publicity Release (where legal) as a condition of being named a valid Grand Prize winner and provide, by mail, a recent photo for publicity. The Statement of Eligibility & Liability/Publicity Release must be returned within five business days of Sponsor’s first attempted notification or the Grand Prize will be forfeited.

  10. RESPONSIBILITY. By entering the Contest, each Entrant accepts and agrees to these Official Rules and the selection by the judging panel and the majority public vote that will determine the Contest’s three finalists and the Grand Prize winner, respectively, as outlined in the terms above. By entering this Contest, the Entrant agrees to indemnify and hold Sponsor and each Home Instead Senior Care® franchise office, and all of their respective directors, officers, employees, representatives, agents, assigns, subsidiary and affiliated companies, and advertising and promotion agencies harmless for any injuries, losses or damage of any kind, including death or property, resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the Grand Prize or participating in this Contest or any Contest-related activity. Sponsor has not made and/or is not responsible for any misrepresentation or guaranty, express or implied, in fact or in law, relative to the Grand Prize. All federal, state, provincial and local laws and regulations apply. Sponsor assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors or failures of any kind, or delayed computer transmissions or network connections that are human or technical in nature. Sponsor reserves the right in its sole discretion to cancel or suspend this Contest, in its entirety or in part, should virus, bug, tampering, unauthorized intervention, fraud, technical failures or other causes beyond Sponsor's control corrupt the administration, security, fairness or integrity of the Contest. Sponsor is not responsible for incorrect or inaccurate Entry information, whether caused by Entrants, administrator, any of the equipment or programming associated with or utilized in the Contest, or by technical or human errors, which may occur in the processing of the Entries in the Contest. Neither Sponsor nor its agents are responsible for injury or damage to Entrants' or to another person's computer related to or resulting from participating in this Contest. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the Entry submission process or the operation of the Contest or any Contest-related website, or to be acting in violation of the Official Rules. Sponsor reserves the right to modify, suspend or terminate this Contest, or change the rules of this Contest, if the Contest is unable to be run as planned, in Sponsor’s sole discretion. By entering this Contest, Entrants agree that any and all disputes and claims arising out of or in connection with this Contest or the Grand Prize shall be resolved individually without resort to any form of class action, and that any claims, judgments and awards shall be limited to actual out of pocket costs incurred (and in no event attorneys’ fees), and under no circumstances will any Entrant be permitted to obtain any award for punitive, incidental or consequential damages. In the event that the Grand Prize winner chooses not to accept his or her Grand Prize, is not in compliance with the Official Rules, is unable to be notified, or cannot attend the family reunion on the specified dates agreed on by Sponsor and Entrant, the Grand Prize will be forfeited and an alternate Grand Prize winner may be randomly selected from all of the remaining qualified Entries. In the event of any discrepancy or inconsistency between the terms and conditions of the Official Rules and disclosures or other statements contained in any Contest-related materials, including but not limited to the Contest entry form, or point of sale, television, print or online advertising, the terms and conditions of the Official Rules shall prevail, govern and control.

  11. GRAND PRIZE WINNER DISCLOSURE.   12. SPONSOR. Home Instead, Inc., located at 13323 California Street, Omaha, NE 68154, is the franchisor of the Home Instead Senior Care® franchise network of independently owned and operated franchise offices and is the Sponsor of, and is responsible for, this Contest and the awarding of the Grand Prize. All participants acknowledge and agree that Sponsor shall be solely responsible for the Grand Prize and shall not be liable for any act of omission arising out of, or related to, this Contest.
